Right of Way Activity
On April 27th, 2021 City Council approved a new Right-of-Way Activity Policy, Public Works-023. The City of Brantford is committed to implementing efficient policies and practices that ensure the health and safety of the public. This new policy reduces the number of permits required, eliminates duplicate or triplicate document submissions and streamlines the applicable fee structure.
All applications for the Right-of-Way Activity Permit should be submitted using the online application.
A Right-of-Way Activity Permit is required by any person, utility company or contractor performing activities within City streets right-of-way. An approved permit must be obtained prior to any work commencing.
Permit Process
Applicants are to apply with the Issuer of Permits not less than fifteen (15) working days in advance of the right-of-way activity.
In order to assist you in applying online, throughout the course of the application you may be asked for one or more of the following documents to be uploaded:
- Proof of Commercial general liability insurance including products and competed operations and blanket contractual to a limit of not less than two million dollars ($2,000,000) per occurrence. The policy will be endorsed to name The Corporation of the City of Brantford as an additional insured.
- Standard form automobile liability insurance that complies with all requirements of the current legislation of the Province of Ontario, having an inclusive limit of not less than two million dollars ($2,000,000).
- Security in the minimum amount of $2,000.00 in a form of cash deposit, certified cheque, credit card or bond, if applicable;
- Applicable permit fee;
- Security deposit, if applicable;
- Detailed diagram, drawing or map;
- Notification letter, if applicable;
- Traffic control plan;
- Proof of parking arrangements, if applicable;
- Proof of General Building Trades Licence, if applicable;
- Proof of Municipal Consent, if applicable.
Permit Fees
Effective immediately, in accordance with the Fees and Charges By-law, as amended from time to time, all applications will be subject to a $115.00 application fee and where applicable a $115.00 inspection fee, to be paid at time of submission.

Staff review of all applications will not commence until all fees are paid in full and until all requirements have been met to the satisfaction of the Issuer of Permits. All fees and charges are in accordance with the Fees and Charges By-law.
Permit Exemptions
- Work deemed minor in nature and of very short duration, at the discretion of the Issuer of Permits;
- Work being performed by or under contract with the City of Brantford;
- Emergency Services;
- Emergency situations, as deemed by the Issuer of Permits. Notification to roadclosures@brantford.ca is required;
Additional Costs
Should the Right-of-Way Activity Permit authorize a road cut or excavation, the Permit Holder is responsible for the temporary restoration as well as all costs associated with final restoration completed by the City. Details concerning inspection, excavation and restoration can be found in the Right-of-Way Activity Policy. All fees and charges are in accordance with the Fees and Charges By-law.

A Right-of-Way Activity Permit is required by a utility company, contractor or any other agencies, companies or individuals for all excavation work carried out within City street rights-of-way including excavation of streets, curb and gutter and sidewalks, prior to beginning construction work. Any landscape/excavation work being performed on the private side does not require the excavation portion of the permit, only occupancy to account for equipment and/or materials occupying the right-of-way. A Site Alteration Permit may be required based on the work performed. Occupancy/Access Restrictions |
Where the Activity will close a Highway and/or cause general inconvenience to all residents and businesses located beside or near the Right-of-Way where the Activity will occur, every person, Utility Company, or Contractor shall require a Right-of-Way Activity Permit. Driveway/Access |
The City of Brantford requires that a Right-of-Way Activity Permit be obtained for work being performed for the installation of new entrances and driveway alterations. All permits must be applied for and paid in full prior to any construction. The following specifications must be adhered to when changing the size of an existing driveway or when adding a new driveway;
