Notice of Passing of a Heritage Designation By-law Amendment Under the Provisions of Part IV, Section 30.1 of The Ontario Heritage Act, R.S.O. 1990, c. O.18 (as Amended)

TAKE NOTICE that the Council of The Corporation of The City of Brantford passed By-law 5-2025 on January 28, 2025, to amend designation By-law 153-81 for the property municipally known as 34 Myrtleville Drive, in the City of Brantford, Province of Ontario, as a property of cultural heritage value or interest under Part IV of the Ontario Heritage Act, R.S.O. 1990, c. O.18 (as amended).

Purpose and Effect of Amendment

34 Myrtleville Drive, also known as the Myrtleville House Museum and Farmstead and formerly 191 Balmoral Drive, was designated in 1981 by By-law 153-81 as a property of historic or architectural value or interest under Section 29 of the Ontario Heritage Act. The property is also described as: PIN 32219-0063 (LT), PT LT 27, CON 2 TWP OF BRANTFORD, PART 1, 2R1370 & PART 1, 2R266; BLK 99, PL 1650; T/W A224542; S/T A318536 BRANTFORD CITY.

The purpose of the amending by-law is to correct the legal description and municipal address of the property, and to clarify the statement of cultural heritage value or interest associated with the property’s use by the Good family, the property’s physical and design value, the property’s ability to yield information that contributes to an understanding of a community, and the property’s historical links to its surroundings. The amendment (By-law 5-2025) further adds a list of heritage attributes and otherwise revises By-law 153-81 to be consistent with the requirements of the Ontario Heritage Act.

Appeal by Owner to the Ontario Land Tribunal

TAKE NOTICE that in accordance with Subsection 30.1 (10) of the Ontario Heritage Act, the owner of 34 Myrtleville Drive may appeal the amending By-law 5-2025 by submitting a Notice of Appeal to the Ontario Land Tribunal and the City Clerk of The Corporation of the City of Brantford, Attention: Chris Gauthier, City Clerk, 58 Dalhousie Street, Brantford, ON, N3T 2J2, by 4.30 p.m. on or before March 3, 2025. A Notice of Appeal must set out the reasons for the objection to the By-law and be accompanied by the fee required by the Ontario Land Tribunal.
