Local Planning Appeal Tribunal (LPAT) issues final order for 620 Colborne Street
On Thursday, October 22, 2020 a settlement hearing between Liv Developments Ltd. (the Applicant), the City of Brantford, and the County of Brant was held under subsection 22(7) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, to consider a matter arising from the appeal of Liv Developments Ltd, with respect to their subdivision application for the property located at 620 Colborne Street West in Brantford.
On January 27, 2021 LPAT issued its decision to approve the settlement reached between the parties with the stipulation to withhold its final order until such time as the parties confirm that certain conditions have been satisfied, including a contribution agreement between the County of Brant and the Applicant.
On May 5, 2021, LPAT issued its Final Order, having been notified that the stipulated conditions of their interim order have now been satisfied. The applicants will now be required to satisfy their Conditions of Draft Plan Approval, and will be required to receive final Site Plan Approval prior to any development taking place.
Once a matter is appealed to the Local Planning Appeal Tribunal (LPAT), the final decision on any such matter rests with the LPAT and not with the Council of the City of Brantford. The draft, proposed plan and by-laws related to this development were reviewed by staff for the City of Brantford and the County of Brant, and conditions with respect to the approval of the plan were proposed to LPAT and considered during their review process. The LPAT also considered the written submissions of a participant in the hearing. In an effort to ensure that public input was considered, The City of Brantford respectfully requested that the LPAT give due consideration to the interests of the public and participants in this matter, including affording the public with an opportunity to review and comment on the proposed, draft plans and documents submitted to the LPAT in advance of the hearing date. The decision of the LPAT in this matter recognized that future approvals will be required prior to the development of these lands by the Applicant, and that those approvals include opportunities for public input into the planning process.
