January 28, 2021 Update

On Thursday, October 22, 2020 a settlement hearing between Liv Developments Ltd., the City of Brantford, and the County of Brant was held under subsection 22(7) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, to consider a matter arising from the appeal of Liv Developments Ltd, with respect to their subdivision application for the property located at 620 Colborne Street West in Brantford.

On January 27, 2021 LPAT issued its decision to approve the settlement reached between the parties  with the stipulation to withhold its final order until such time as the parties confirm that certain conditions have been satisfied, including a contribution agreement between the County of Brant and the Applicant.

Settlement Hearing October 22, 2020 

A settlement hearing between Liv Developments Ltd., the City of Brantford, and the County of Brant will be held at 10:00 a.m. on Thursday, October 22, 2020. As outlined below, the matter to be considered arises from the appeal of Liv Developments Ltd, with respect to their subdivision application for the property located at 620 Colborne Street West.

Due to restrictions in place to protect public safety during the COVID-19 pandemic, the LPAT is not currently meeting in person; therefore, this hearing will proceed by way of video conference.

To that end, appended to this public notice is a copy of the Applicant’s draft, proposed plan and by-laws which will be the subject of consideration by the LPAT at the above-noted settlement hearing. Please note that once a matter is appealed to the LPAT, the final decision on any such matter rests with the LPAT and not with the Council of the City of Brantford. The draft, proposed plan and by-laws have been reviewed by staff for the City of Brantford and the County of Brant, and conditions with respect to the approval of this plan have been proposed for consideration by the LPAT. The City of Brantford has respectfully requested that the Local Planning Appeal Tribunal (LPAT) give due consideration to the interests of the public and participants in this matter, including affording the public with an opportunity to review the proposed, draft plans and documents submitted to the LPAT regarding this matter in advance of the hearing date.
